With social media becoming increasingly present in the workplace, employers must be prepared to handle employee conduct as it transpires across digital platforms. While there are many legitimate business interests that require employee engagement online, from time to time, that engagement is not productive; indeed, when social media and other digital platforms are used incorrectly, it can be harmful or destructive for the individuals or businesses that are the subject of the content. When employees post objectionable, offensive, or unlawful content online, employers should analyze the legal and other risks that may result from the posts, and consider whether and what discipline may be warranted.

Desiree F. Moore is a trial attorney who has successfully litigated in state and federal court. Ms. Moore has managed high-level disputes in sectors such as cryptocurrency, social media, intellectual property, entertainment, product liability, labor and employment, and class action defense at the trial and appellate court level. In addition to her litigation practice, Ms. Moore regularly helps clients identify and manage the risks associated with social media use. Ms. Moore counsels individuals and corporations alike on social media best practices, how to effectively implement regulations for social media use in and outside of the workplace, and social media crisis management.
Erinn L Rigney, Associate
Erinn L. Rigney is an associate in the Chicago office, focusing her practice on labor, employment and workplace safety. Her counseling experience includes advising clients on compliance with federal, state, and local antidiscrimination laws in conjunction with various employment actions; the provision of reasonable accommodations; compliance with the Fair Labor Standards Act and state wage and hours laws; and implementation of workplace policies and employee handbooks, in addition to developing and leading anti-harassment training sessions for clients’ workforces. Ms. Rigney also has significant experience addressing the various employment issues that arise in the health care space.
